Knightstown man faces multiple charges

Greensburg — A Knightstown man faces multiple charges following his arrest Thursday morning.

According to charging information filed in Decatur Superior Court Aug. 17, James D. Love, 26, has been formally charged with operating while intoxicated, operating a vehicle with a controlled substance in the body, and possession of a Schedule IV controlled substance, all of which are class “D” felonies.

Love also faces a misdemeanor charge of carrying a handgun without a license. A warrant for Love’s arrest was issued the same day.

The charges stem from an alleged incident the morning of May 22, during which Love was stopped by Decatur County Sheriff’s Department (DCSD) Deputy Rob Goodfellow for driving in an unsafe manner on State Road 3.

Deputy Goodfellow’s report maintains Love crossed the center line and the fog line of State Road 3 while operating his white 2002 Pontiac Grand Am that morning, actions that led to the traffic stop.

Following the stop, Love is alleged to have exhibited multiple signs of intoxication, prompting Goodfellow to administer a field sobriety test.

Love told Goodfellow he had been texting on his cell phone, which caused his erratic driving. The report states Love subsequently failed three standard field sobriety tests. The suspect later agreed to a chemical test by having his blood drawn at Decatur County Memorial Hospital (DCMH).

During initial contact with law enforcement officials, Love informed Goodfellow and DCSD Deputy Steve Snyder that there was a gun in the vehicle, a loaded .22 caliber Beretta. Love’s permit for the weapon had expired in January. Snyder later located “several tablets in what appeared to be a plastic cigarette wrapping,” according to the report. The tablets were identified as 2 mg Alprazolam, an anti-anxiety prescription medication. Alprazolam is a Schedule IV controlled substance. Love had been prescribed .5 mg Xanax, a name brand for Alprazolam.

Love was later released into the care of his counselor, following having his blood drawn at the DCMH Emergency Room.

During a review of Love’s driving record and criminal history, Goodfellow discovered the suspect had previously been convicted of a charge of operating while intoxicated in Sept. 2011 in Hancock County.

Love is presently incarcerated in the Decatur County Jail. A cash bond in the amount of $20,005 was set for him during a court appearance Friday.
